Information request and response under the Freedom of Information (Scotland) Act 2002.
Information requested
I am writing to request information under the Freedom of Information (Scotland) Act 2002 regarding the governance and ownership structure of the MyCare.scot digital health and social care platform.
Specifically, I would like to request the following:
1. A breakdown of the ownership and governance responsibilities for MyCare.scot between:
a. NHS Education for Scotland
b. The Scottish Government
c. Any external contractors or delivery partners, including BJSS and/or CGI.
2. Copies of any partnership agreements, memoranda of understanding, or contracts that outline the roles, responsibilities, and ownership rights of each party involved in the development, delivery, and ongoing management of MyCare.scot.
3. Clarification on whether BJSS or any other external contractor holds any intellectual property rights, data management responsibilities, or operational control over any part of the MyCare.scot platform.
4. The governance structure overseeing MyCare.scot, including any steering groups, programme boards, or oversight committees, and the representation of each stakeholder within these bodies.
5. The designated data controller for MyCare.scot under UK GDPR, and any data processing arrangements involving third-party contractors.
Response
While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested due to exemptions under the following sections:
- Section 25 of FOISA exempts information from disclosure where the requester can reasonably obtain the information without making a request for it. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
- 38(1)(b) of FOISA (the personal information) applies to some of the information requested. The information redacted under 38(1)(b) are the names of junior officials in email addresses. The details of the primary attendees are included. No other information was withheld under section 38(1)(b). I have reviewed the application of the exemption, and I am satisfied that it was applied correctly, and that disclosing the information would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
In relation to the questions one, two and four I have enclosed copies of documentation that contain the information you have requested, see appendix below.
In relation to question three I can confirm the Scottish Government does not hold documentation pertaining to this question for release. NHS National Education for Scotland are responsible for the operational delivery of the service and will be best placed to help with this question.
In relation to question five, Section 25 of FOISA applies.
