Material regarding mistaken releases: FOI release

Information requested

1. Copies of any briefings to Ministers, Special Advisers or Directors since 1 April 2020 that mention “release in error”, “erroneous release”, or “mistaken release” in the Scottish Prison Service.

2. Any correspondence between the Scottish Government and the Scottish Prison Service about the scale, causes, or prevention of such incidents.

3. Any action plans or recommendations produced as a result.

4. A list of any risk registers from that SG’s prisons policy unit is involved in.

Response

I enclose a copy of most of the information you requested in the format you asked for.

Exemptions under section38(1) and 30(b)(i) of FOISA apply to some of the information you have requested.

All personal information has been redacted.

All information that comes under “free and frank advice” has been redacted.

The information that has been attached falls under part 1 and 2 of your request. We do not hold any information in reference to part 3.

In relation to part 4, there are risk registers for both the Community Justice Division and the Justice Directorate. Neither of these include mistaken release.
