Information request and response under the Environmental Information (Scotland) Regulations 2004.
Information requested
I am looking for information/statistics relating to the Trunk Road between the Bankhead roundabout to the Preston Roundabout in Glenrothes, Fife.
The information I seek is as follows:
1. how many accidents/incidents/collision/crashes has there been on this piece of road over the past 10 years;
2. what was the make; model; and year of the vehicle involved;
3. what were the recorded weather conditions at the material time;
4. how many passengers were within the vehicles at the material time;
5. what was the recorded speed of the vehicle at the material time;
6. what was the precise (if possible) part of the road that the accident/incident/collision/crash occurred;
7. how many vehicles were involved in the accident/incident/collision/crash;
8. what was the known/recorded injuries of all persons involved in the accident/incident/collision/crash;
9. how many drivers have been charged by the police afterwards;
10. how many drivers, after being charged, were prosecuted by COPFS under the Road Traffic Scotland Act;
11. and did any of the emergency services including the recovery services treat the road afterwards for example place sand over any areas of concern.
Response
As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.
This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.
1. Over the past ten years, there have been sixteen reported personal injury accidents (from 01 January 2015 to 09 September 2025). The extents taken were from Preston Roundabout to Bankhead Roundabout (not including the roundabouts). These are shown in Annex A.
Under the terms of the exception at regulation 10(4)(a) of the EIRs (information not held), Transport Scotland is not required to provide information which it does not have. Transport Scotland does not have the information you have requested because the records we hold relate to collisions where someone is injured or killed, and which become known to Police Scotland. Therefore, we do not hold records relating to damage-only collisions.
This exception is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exception. We have found that, on balance, the public interest lies in favour of upholding the exception. While we recognise that there may be some public interest in information about damage-only collisions, clearly we cannot provide information which we do not hold.

An exception under regulation 11(2) of the EIRs (personal information) applies to some the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exception is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.

4. Under the terms of the exception at regulation 10(4)(a) of the EIRs (information not held), Transport Scotland is not required to provide information which it does not have. Transport Scotland does not have the information you have requested because the number of passengers in the vehicles are not recorded.
This exception is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exception. We have found that, on balance, the public interest lies in favour of upholding the exception. While we recognise that there may be some public interest in information about the number of passengers in the vehicles at incidents, clearly we cannot provide information which we do not hold.
5. Under the terms of the exception at regulation 10(4)(a) of the EIRs (information not held), Transport Scotland is not required to provide information which it does not have. Transport Scotland does not have the information you have requested because the speed of the vehicles at the time of incidents is not recorded.
This exception is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exception. We have found that, on balance, the public interest lies in favour of upholding the exception. While we recognise that there may be some public interest in information
about the speed of vehicles at the time of incidents, clearly we cannot provide information which we do not hold.

Transport Scotland does not have the information you have requested because there is no information held connecting fuel spillages directly to the personal injury accidents referred to in Annex A.
This exception is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exception. We have found that, on balance, the public interest lies in favour of upholding the exception. While we recognise that there may be some public interest in information about any of the emergency services including the recovery services treating the road afterwards for example placing sand over any areas of concern, clearly we cannot provide information which we do not hold.
