Response
I have now completed my review of our response to your request under the Freedom of Information (Scotland) Act 2002 (FOISA) for –
1. In the last five financial years (inclusive of 2024/25), please provide the details of which matters counsel or legal advice was sought for any cumulative cost of legal fees of less than £50,000.
2. This should include live and closed matters, with "matters" taken to be a general description of the action, not the legal specifics, in a way which would eliminate any prejudice in disclosing the sums spent on the action.
You asked that the scope of the request be reduced to include only the last three years, including 2024/2025.
Your request for review states that you are unhappy with our initial response as it did not provide the costs requested at part 2) of your request.
My review is therefore limited to reconsideration of our response to part 2) of your request in terms of the costs requested.
I have been asked by the Director of Legal Services to carry out a review of our original response to your request under the Freedom of Information (Scotland) Act 2002 (FOISA), as set out above. I have now completed that review.
I have concluded that, in respect of the matter that I am reconsidering, i.e. the provision of costs, that a different decision should be substituted.
I have concluded the costs associated with each of the cases with which you were originally provided should be disclosed. These are attached in the undernoted table. I apologise that these were not included in the original response.
