Tendering process for Victoria Quay Nursery: FOI release

Information requested

In this email, references to “the nursery” mean the workplace nursery at Victoria Quay.

1) All information, including reports, correspondence and internal communications (whether draft or in final form), about:

a) the prior information notice concerning the nursery (reference NOV517599) published on the Public Contracts Scotland website on 5 November 2024.

b) the contract notice concerning the nursery (reference JAN522201) published on the Public Contracts Scotland website on 21 January 2025.

2) Copies of all tender documentation provided in response to the above contract notice.

3) Correspondence with all tenderers and prospective tenderers in connection with the above contract notice.

4) All information, including reports, correspondence and internal correspondence (whether draft or in final form), about alternative methods (such as a direct award) of procuring a supplier to operate the nursery.

For the avoidance of doubt, the above requests include (but are not limited to) all information contained in handwritten notes, messages sent via Microsoft Teams and messages sent via Whatsapp or other messaging service.

Response

Please find attached the response to the questions raised in your recent Freedom of Information request dated 15th June 2025. An exemption under section s.38(1)(b) of FOISA applies to some of the information you have requested. The exemption applies to all individuals named in the attached e-mail chains who are below Senior Civil Service grade in the Scottish Government. Section 38(1)(b) is being applied as disclosure of the information requested would contravene the data protection principles in Article 5(1) of the GDPR.

An exemption has also been applied under s.33(1)(b) to the financial information included within the procurement documentation and contractor responses.

Question 1 - The information you have requested is included within attachments 1-3.

Question 2 - The information you requested is included within attachments 4 - 14.

Question 3 - All information requested is included within the responses given in Questions 1,2 and 4 as communications with all parties would take place on the Public Contracts Scotland portal. No other information relation to this question has been found.

Question 4 - All information you requested is included within attachments 15 -19.
