Information requested

Any correspondence sent between John Swinney, Shirley-Anne Somerville or Kaukab Stewart to or from the UK Government relating to the For Women Scotland Supreme Court decision and or the Equality and Human Rights Commission’s interim guidance following the Supreme Court’s judgement.

Response

I have attached documents relating to

  • correspondence sent from Scottish Government to and from the Equality and Human Rights Commission’s regarding the interim guidance following the Supreme Court’s judgement.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under Section 28 (Relations within the United Kingdom) and under section 38(1)(b) (personal information) apply to that information.

The reason why these exemptions apply are explained below.

An exemption under Section 28 Relations within the United Kingdom (1) of FOISA applies to some of the information you have requested. Information is exempt information if its disclosure under this Act would, or would be likely to, prejudice substantially relations between any administration in the United Kingdom and any other such administration

An exemption under section 38(1)(b) (Personal Information) of FOISA applies to some of the information you have requested. This has been applied to names, email addresses, contact numbers, pronouns and salutations where necessary.

These exemptions are not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
