Staff costs in General Practice that are funded by the Scottish Government: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002

Information requested

As section 5 states and staff costs in General Practice are being fully refunded by the Scottish Government through taxation and National Insurance does General Practice in Scotland have to comply with legislation and policy as other public sector bodies do, specifically;

  • Comply with Employment Law
  • Comply with the Equality Act (2010)
  • Comply with the Public Sector Equality Duty
  • Comply with policies within the overarching territorial Health Board for example Dignity at Work

Response

While our aim is to provide information whenever possible, in this instance the Scottish Government does not have any documentation relating to the information you have requested.

Although we do not hold this information any employer has to comply as appropriate with relevant employment and equality law. How that applies to any specific situation or contract of employment would be a matter for legal advice. While costs in general practice are funded by the Scottish Government, direct reimbursement of practice expenses (including employment costs) as part of Phase Two of the 2018 GP Contract is still being negotiated with the BMA.
