Transport Scotland - A8 emergency road works: EIR release

Information request and response under the Environmental Information (Scotland) Regulations 2004.


Information requested

With regards to roadworks on the A8 trunk road you asked for the following:

1. What is the service level agreement in regard to these roadworks being carried out by AMEY on the A8?
2. Why was no work carried on at this location on March 15th?
3. How are complaints to AMEY from Inverclyde and Renfrewshire West logged and how many have been received in the last 6 months?

As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.

For the purposes of this request we have assumed that the works referred to are the works on A8 East Hamilton Street which commenced on 10 March.

1. What is the service level agreement in regard to these roadworks being carried out by AMEY on the A8.

There is not a separate agreement for these works. The Service Agreement is contractual between Transport Scotland and Amey and relevant to all work undertaken on the trunk road and motorway network. ​​​​​​​2. Why was no work carried on at this location on March 15th?

The works referred to on the A8 East Hamilton Street will ensure the route is resilient during future periods of heavy rainfall. On 15 March these drainage works were suspended due to issues experienced with other utilities. The utilities encountered within the planned drainage route were not at the line and level expected which resulted in the works being unachievable within the planned traffic management. The completion of the works was reconsidered by Amey's, drainage design team.

3. How are complaints to AMEY from Inverclyde and Renfrewshire West logged and how many have been received in the last 6 months?

Between 1/11/2024 and 1/4/2025 12 complaints have been made to Amey for the Inverclyde and Renfrewshire West areas. These complaints are logged on Amey's incident management system and passed to the relevant Area Manager for response direct to writer.
