Equality and Human Rights Commission communications regarding separate or single sex toilets in schools: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.

Information requested

Any written communication in the last year with the Equality and Human Rights Commission which mentions separate or single sex toilets in schools or the Government guidance Supporting Transgender Pupils in Schools.

Response

I enclose a copy of most of the information you requested in the attached Annex.

An exemption under section s.38(1)(b) of FOISA applies to some of the information you have requested. This is because the correspondence requested includes some personal information relating to individuals.

This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

The correspondence also includes information which is outside of the scope of your request, therefore this information has also been redacted and clearly marked as being out of scope.
