Response

Response to your request (part 2)

Please note that although you asked us to supply all documentation held by the Scottish Government, including correspondence sent and received (including internally), briefings, minutes/notes from meetings, analysis, about Waspi women compensation, between December 1 2024 and February 1 2024? We have interpreted this as ‘Could you supply all documentation held by the Scottish Government, including correspondence sent and received (including internally), briefings, minutes/notes from meetings, analysis, about Waspi women compensation, between December 1 2024 and February 1 2025?’

While our aim is to provide information whenever possible, in this instance the costs of locating, retrieving and providing the information requested would exceed the upper cost limit of £600. This is due to a large volume of data within the documents our searches identified. Under section 12 of FOISA public authorities are not required to comply with a request for information if the authority estimates that the cost of complying would exceed the upper cost limit, which is currently set at £600 by Regulations made under section 12.

You may, however, wish to consider reducing the scope of your request in order that the costs can be brought below £600. One way you could do this is by narrowing the timeframe. You may also find it helpful to look at the Scottish Information Commissioner's 'Tips for requesting information under FOI and the EIRs' on his website at: http://www.itspublicknowledge.info/YourRights/Tipsforrequesters.aspx.

Response to your request (part 3)

While our aim is to provide information whenever possible, in this instance the Scottish Government does not have some the information you have requested as the meeting was a political (as opposed to a Scottish Government) meeting and therefore there is no official briefing, minutes or notes.

An exemption under section s.38(1)(b) (personal information) of FOISA applies to some of the information you have requested. The personal information, including names and contact details of officials is their own personal information, and is therefore exempt under FOISA. This exemption is not subject to the ‘public interest test’, thus, we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
