Information requested

Road Maintenance records and road fault reports.

I request the maintenance checks carried out on the section of road mentioned. The section is governed by these two markers :

What three words ///entire.renew.neon and ///trick.worker.term On the dates between 4th July 2024 and the 31st October 2024.

Road surface checks requested.

I request the slow moving vehicle’s details and reports that was constructed during scans of this the road between 4th July 2024 and 31st October 2024.

Response

As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.

The location of your request was indicated by you using the "what3word"s website. In accessing this website I have established the location in question is Whitecraig, West Lothian. you confirmed this was correct by email on 6 march 2025.

Please see Annex A to this response for information regarding the location, date and outcome of safety inspections completed within the dates of your request. This data advises two defects were detected within this timeframe. Transport Scotland's Operating Company, Amey advise both defects were for graffiti.

You asked for information regarding road surface checks, requesting the slow moving vehicle’s details and reports that was constructed during scans of this the road between 4 July 2024 and 31 October 2024, Speed of vehicle, type of vehicle, registration, road worthiness of vehicle and relating documents.

While our aim is to provide information whenever possible, in this instance Transport Scotland does not have the information you have requested. This is because the road surface is not scanned during inspections. It is inspected visually by BEAR Scotland Asset inspectors. Therefore we are refusing your request under the exception at regulation 10(4)(a) of the EIRs.
