1. In each year since 2019/20, including the current year to date, how many Electronic Monitoring Orders have been imposed.

2. In each year since 2019/20, including the current year to date, how many Electronic Monitoring Orders have been breached. Please provide this as a raw number but also as a percentage of all orders.

2. While our aim is to provide information whenever possible, in this instance the Scottish Government does not have some of the information you have requested. The reasons why we don't have the information are explained below.

Reasons for not providing information

The Scottish Government does not hold the information requested

The Scottish Government does not have the information you have asked for regarding the number of breaches of electronic monitoring orders recorded since 2019/20 because electronic monitoring covers a number of different orders and licences across the justice system. While compliance information is always provided back to the relevant responsible authority (e.g. parole board, prison or court) the questions of how they then respond, and whether they agree that a breach has occurred is a matter for the responsible authority for that order. As such, I hereby provide you with formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested.
