Information request and response under the Environmental Information (Scotland) Regulations 2004.
Information requested
1. Please provide the business case for Ardrossan Harbour.
2. What works are required to the harbour?
3. How much are these works projected to cost?
4. How much money has been spent on Ardrossan Harbour since 2018? Please provide a breakdown by year and by expenditure type.
5. How much money has been spent on the Ardrossan Harbour Task Force since 2018? Please provide a breakdown by year and by expenditure type.
6. Please provide an update on the effectiveness of the Ardrossan Harbour Task Force.
Response
As the information you have requested is ‘environmental information’ for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.
This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.
1. While our aim is to provide information whenever possible, in this instance we are unable to provide the information you have requested because an exception(s) applies under EIR regulation(s) The reasons why that exception(s) apply are explained in the Annex to this letter.

3. The projected costs of works you have requested is available from a previous FOI request (FOI/202300386171) which is published on the Scottish Government website - Information relating to Scottish ferries costs and upgrades: EIR release - gov.scot. Under regulation 6(1)(b) of the EIRs, we do not have to give you information which is already publicly available and easily accessible to you in another form or format. 4. It is the responsibility of Ardrossan Harbour Company Limited (part of Peel Ports Group) as statutory harbour authority to ensure the harbour is fit for purpose, maintain and upgrade the harbour infrastructure where required and associated costs related to these aspects.

6. The development works at Ardrossan are overseen by a Ministerial Task Force which is co-chaired by Fiona Hyslop, Cabinet Secretary of Transport, and Councillor Marie Burns, Leader of North Ayrshire Council’ and brings together Transport Scotland, Peel Ports Group Ltd, CalMac Ferries Ltd (CFL), Caledonian Maritime Assets Ltd (CMAL), the Isle of Arran Ferry Committee and Kenneth Gibson MSP.
