12 weeks have passed since you sent your letter on 8 March 2023 and the documents have not been published. Please provide the documents as was originally requested.
Response
I have concluded that a different decision should be substituted.
In our original FOISA reply letter dated 08 March 2023, it was stated that an exemption applied, namely 27(1) of FOISA (information intended for future publication) for some of the information you requested. Following my review of your case I have found that our application of this exemption was indeed correct at at the time of your original FOISA request as it was the intention for this information to be published within 12 weeks. However, due to unforeseen circumstances, the information has not been published to the Scottish Government website within this timescale. Therefore I have concluded that the information you have requested should be released and is attached to this letter.
In your orignal FOISA request, dated 07 February 2023 you had asked for “the minutes, agendas and associated papers for the meetings of the cladding stakeholder group in November 2022, December 2022, and January 2023”
The agenda and minutes of the cladding stakeholder group meeting held in November 2022 are attached to this letter.
As noted in our initial response no meetings of the cladding stakeholder group took place in December 2022 or January 2023 therefore no information is held for release. In conducting my review I am satisfied that the Scottish Government do not hold this information. This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested in relation to meetings in December 2022 or January 2023.
