Information requested

  1. Correspondence from members of the public received by any Scottish Minister (through their Scottish Government email) regarding the Sentencing young people guidelines. Please provide all correspondence between 1 January 2023 and the present date.
  2. Correspondence from members of the public received by any Scottish Minister (through their Scottish Government email) regarding the Sean Hogg case. Please provide all correspondence between 1 January 2023 and the present date.
  3. Correspondence from members of the public received by any Scottish Minister (through their Scottish Government email) regarding the Rhys Bennett case. Please provide all correspondence between 1 January 2023 and the present date.

Response

You have asked for the information to cover the period between 1 January 2023 to the present day. We have taken the present day to mean the date of your email which is 1 June 2023. Therefore, we have provided information from 1 January 2023 to 1 June 2023.

I have set out below the reply to your FOI request

Part 1

No correspondence was received or collected by the Scottish Government. This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested.

Part 2 and 3

While our aim is to provide information whenever possible, we are unable to provide some of the information you have requested because an exemption under section 38(1)(b) (personal information) of FOISA applies. This exemption applies to the names of third parties referenced throughout the documents that have been requested. These exemptions under Sections 38(1)(b) apply to protect the personal data of a third party, i.e. names and contact details, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. The Scottish Government has a policy of not disclosing the names of officials who are not Senior Civil Servants.

This exemption covers 58 documents relating to the Part 2 of your FOI request and 4 documents relating to part 3 of your FOI request.

The following exemption apply, s.30(b)(i) (Free and frank exchange of views) to one document in part 2 of your request. This exemption allows Ministers a private space to seek views of colleagues.
