Information request and response under the Freedom of Information (Scotland) Act 2002
Information requested
The funding application/s made to Scottish Government by LGBT Youth Scotland for the past 3 years. A breakdown of the funds awarded and any information on proposed future funding as well as copies of the funding agreements that LGBT Youth Scotland agreed to when they accepted the grants.
Response
We have interpreted “last 3 years” to be financial years 2020/21, 2021/22 and 2022/23.
Funding applications
While our aim is to provide information whenever possible, in this instance we are unable to provide the funding applications for 2020/21 because an exemption under section 33(1)(b)) of FOISA applies to that information. Disclosure would (or would be likely to) prejudice substantially the commercial interests of LGBT Youth Scotland.
This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption. We recognise that there is some public interest in release because the funding applied for comes from public funding. However, this is outweighed by the public interest in preventing substantial prejudice to the commercial interests of LGBT Youth Scotland.
The Scottish Government is unable to provide funding applications for 2021/22 and 2022/23 as it does not hold these.
Breakdown of funds
Under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you. If, however, you do not have internet access to obtain this information from the website listed, then please contact me again and I will send you a paper copy.
