Meta data request regarding FOI 202200299795: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.


Information requested

The following information under FOISA as it relates to FOI request 202200299795.

1) Any and all correspondence within the Scottish Government, in particular including special advisers, relating to the above request. For clarity, the correspondence should include - but not be limited to - emails, WhatsApp messages and phone calls.

2) Minutes of any meetings where the above request was discussed as well as the time and date of the meetings and a list of attendees.

Response

In response to part 1) of your request, information in-scope of your request is included within an annex which has been sent under separate cover.

In response to part 2) of your request, the Scottish Government does not have the information you have asked for and therefore this is a formal notice under section 17 of the FOISA that the Scottish Government does not hold the information that has been requested.

An exemption under regulation 38(1)(b) of the FOISA (personal information of a third party) applies to some of the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.
