"I'd like to see all documents and communication relating to Springfield Properties and their proposed development in Drumnadrochit that the Scottish Government have dealt with."

Your request relates to 2 linked appeals regarding the following :

  • PPA-270-2223 - Land 125M Sw Of Scottish Fire And Rescue Service, Drumnadrochit - appeal in respect of the Formation Of a Mixed Use Village Core Of Nursery, Office Space And Retail (Food And Non-Foodand.
  • PPA-270-2222 - Land at Drum Farm, Drumnadrochit – appeal in respect of the erection Of 93 (Including 24 Affordable) Homes And Associated Works.

Please note case documentation remains on our website for 7 years from the date the decision is made to provide resource material on the SG decision making process. The decision issued by the DPEA and other key documentation is retained for 30 years. In line with our Publication Policy, this does not include, amongst others, letters issued by DPEA and letters of representation received from members of the public which are removed 12 weeks after the date of the decision. Given the decisions in these appeals were issued a year ago, I have therefore arranged to republish to our website any documentation which was removed after the 12 week period. In light of the above, under regulation 6(1)(b) of the EIRs, we do not have to give you information which is already publicly available and easily accessible to you in another form or format. If, however, you do not have internet access to obtain this information from the website(s) listed, then please contact me again.

I also attach copies of documentation which was not published to our website . Any unpublished documentation related to matters of an administrative nature or not published due to sensitive protected species information. All of these documents are attached.

An exception under regulation 11(2) of the EIRs (personal information) applies to some of the information requested because it is personal data of a third party and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exception is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exception.
