M74 Southbound Lane Closures: EIR release

Information request and response under the Environmental Information (Scotland) Regulations 2004


Information requested

"A list of dates and times of lane closures on the M74 between Junction 1 and Junction 7 on the M74 Southbound between 1st August 2021 and 31st May 2022."

Response

As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.

Annexes A and B to this response contains the lists of lane closures we hold between junctions 1-3 and 6-7, which is maintained on Transport Scotlands behalf by our Operating Company Amey. For information, Annex A lists planned lane closures and Annex B list incidents which resulted in lane closures.

Scottish Roads Partnership (SRP), on behalf of Transport Scotland, operate and maintain the M74 between Junction 3A Daldowie and the approach to, but not including Junction 6 Hamilton/Motherwell.

The information provided by SRP in Annex C to this response, relates to lane closures as a result of both planned works and incidents on the M74 southbound carriageway, between Junction 3A Daldowie and the approach to Junction 6 Hamilton/Motherwell.
