Pausing of the Super Sponsor Scheme: FOI release

Information requested

1) All internal and external correspondence within and sent or received by the Scottish Government including attached documents, meeting handouts, memos, briefings to ministers, attendee lists, location of meeting, notes, minutes, or OneNote memos, linked to the following meetings:

1a) Ivan McKee's meeting with Adrian Gillespie, CEO of Scottish Enterprise on May 4, 2022.

Response

I attach a copy of all of the information you requested.

Exemptions under sections s.38(1), s.30(b)(i) and s.33(b)(ii) of FOISA apply to some of the information you have requested.

S.38(1) applies to information which is personal data i.e. names/contact details of individuals, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

S.33(b)(i) applies to information relating to private companies.

S.30(b)(ii) applies to information which, if released would inhibit the free and frank provision of advice.

In addition, some of the information contained within the briefing document is outwith the scope of the
request as it relates to minutes of previous meetings, and has therefore been redacted.
