Information request and response under the Freedom of Information (Scotland) Act 2002.


Information requested

All correspondence in July 2022 between the Scottish Government and (i) Edinburgh Airport (ii) Border Force and (iii) the Home Office about the immigration status of staff working on the MS Victoria refugee vessel docked at Leith, Edinburgh.

I attach copies of the information you have requested.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under section 38(1)(b) of FOISA applies.

Exemptions under section 38(1)(b) of FOISA applies to the information you have requested. This exemption means the personal data which the disclosure of which would contravene data protection principles is redacted. Personal data includes all information that relates to an individual, and includes identifiers such as name, address, and date of birth. This exemption is not subject to the ‘public interest test’. Therefore, we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption
