"Any, and all, correspondence relating to the Written Parliamentary Questions S6W-07727 and S6W-08295 submitted by Alex Cole-Hamilton (Edinburgh Western).

Response

Further to my letter of 15 July 2022, I have now completed my review of our response to your request under the Freedom of Information (Scotland) Act 2002 (FOISA) (ref: 202200305112). Your initial request being for:

"Any, and all, correspondence relating to the Written Parliamentary Questions S6W-07727 and S6W-08295 submitted by Alex Cole-Hamilton (Edinburgh Western)".

I have concluded that a different decision should be substituted as, on review, the exemptions applied to your original request are either no longer applicable (given that the outstanding Parliamentary Question has now been answered) or had been applied too liberally in the original response.

I now attach a copy of most of the information you have requested.

While our aim is to provide information whenever possible, in this instance an exemption under section(s) 38(1)(b) applies to a small amount of the information requested because it contains personal data of a third party (e.g. names of an individual) and disclosing it would contravene data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
