Information requested

  • For each month of the last 5 years, what percentage of FOI requests received by the Scottish Government are reviewed.
  • For each month of the last 5 years, what percentage of FOI reviews to the Scottish Government are partially or fully upheld.

I enclose a copy of most of the information you requested.

For the purposes of responding to this request I have interpreted that the term 'FoI requests’ and ‘FOI reviews’ refers both to requests and reviews received and are partially or fully upheld under FOISA and the Environmental Information (Scotland) Regulations 2004 (EIRS).

The data I have provided to answer the first part of your request begins in April 2017 when Scottish Government was required to provide monthly performance statistics to the Office of the Scottish Information Commissioner (OSIC). We do not hold any information for the months Jan-March 2017 inclusive – notice under section 17(1) of FOISA that the Scottish Government does not hold information for these months.

In relation to the 2nd part of your request asking: “For each month of the last 5 years, what percentage of FOI reviews to the Scottish Government are partially or fully upheld.” the data I have provided begins on 01 January 2019. During 2018 the Scottish Government transitioned to a new case management system for the handling of correspondence and formal information requests. No business need was identified to retain information relating to the percentage of FOI reviews that were either fully or partially upheld on our previous case management system. So that was not transitioned and so we do not hold that information. This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have some of the information you have requested.

This exemption is not subject to the 'public interest test', so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
