1. On what date did the Scottish Government first receive an embargoed copy of Audit Scotland’s annual report: NHS in Scotland?

2. Please can you provide all briefing and correspondence between officials and ministers (including emails, attachments, typed or handwritten notes, letters, records of phone calls, minutes of meetings, briefings, WhatsApp messages or otherwise) relating to the publication of Audit Scotland’s annual report: NHS in Scotland?

3. Please can you provide all briefing and correspondence between officials and ministers (including emails,  attachments, typed or handwritten notes, letters, records of phone calls, minutes of meetings, briefings, WhatsApp messages or otherwise) relating to the development of a communications strategy for use by the Scottish Government in response to Audit Scotland’s annual report: NHS in Scotland?

Response

In response to your first question, I can confirm that the Scottish Government received a clearance draft of Audit Scotland’s report, ‘NHS in Scotland 2021’, on 17 December 2021, to be checked for factual accuracy. An embargoed copy of the final draft of the report was then shared with the Scottish Government on 21 February 2022.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because an exemption(s) under section s.38(1)(b) (personal information), s.30(b)(i)(free and frank provision of advice) of FOISA applies to that information.
