Information request and response under the Freedom of Information (Scotland) Act 2002


Information requested

1. The number of people convicted of a breach of bail conditions under the Criminal Procedure (Scotland) Act 1995. Please provide this information for the financial years of 2017-18, 2018-19, 2019-20, 2020-21 and so far in 2021-22.

2. The number of people on bail who were convicted of a crime other than a breach of bail conditions. Please provide this information for the financial years of 2017-18, 2018-19, 2019-20, 2020-21 and so far in 2021-22. Please include people convicted of another crime even if they were also convicted of a breach of bail conditions.

3. If possible, the list of crimes that were committed by those on bail (separate to a breach of bail conditions) and the number of times those crimes were committed for the financial years of 2017-18, 2018-19, 2019-20, 2020-21 and so far in 2021-22.

Please note:
(i) The table above contains data on the number of people convicted for a crime that was recorded on the Criminal History System database with a bail aggravator. This means the crime was committed whilst the person was on bail. The number of people convicted of a breach of bail conditions under the section 27(1)(B) of the Criminal Procedure (Scotland) Act 1995 have been removed from this table.

(ii) The data in this table will not match Table 1 of the additional tables on bail-related data published here: Supporting documents - Criminal Proceedings in Scotland, 2019-20 - gov.scot (www.gov.scot). This is because the published table contains data on the number of offences committed rather than number of people convicted, as included in this FOI response. An individual can be convicted of more than one offence during a court proceeding.

(iii) The latest available information on criminal proceedings in Scotland is for the financial year 2019-20. Proceedings database is not a live case system and the 2021-22 information is not yet available. The 2020-21 data will be published later this year.
