I have now completed my review of our response to your request under the Freedom of Information (Scotland) Act 2002 (FOISA) for:

I have reviewed the response to you and have concluded that to release either the finance recovery plan or review report, even in a redacted format would be prejudicial to the commercial interests of the organisation, as explained to you in the original response. However, on review I am able to provide you with redacted copies of both the Invitation to Tender and signed contract.

To provide further clarity it may be helpful to understand the context of your request. The business concerned is an organisation operating within the health and social care sector which provides care and support to our old and vulnerable citizens. As you will be aware, this is an extremely fragile sector, and releasing this information is highly likely to destabilise the market further which may ultimately result in in challenges in providing care and support to users of the organisation’s services many of whom are vulnerable.
