Information request and response under the Freedom of Information (Scotland) Act 2002


Information requested

1. Please list the creative services agencies used by the government during 2021.

2. A list of all appointments made under each agreement during 2021 - detailing the creative services agency used, campaign name, the lead artist / provider and agreed fee.

The following questions relate solely to the creative service agency used for the recent Janey Godley appointment:

Response

I have now completed my review of our response to your request under the Freedom of Information (Scotland) Act 2002 (FOISA) in regard to a questions related to the recent media campaign which involved Janey Godley. You asked for:

(1) please list the creative services agencies used by the government during 2021.

(2) a list of all appointments made under each agreement during 2021 - detailing the creative services agency used, campaign name, the lead artist / provider and agreed fee.

The following questions relate solely to the creative service agency used for the recent Janey Godley appointment:

(3) please provide a copy of the signed contract with the relevant agency.

(4) the fee and basis of the fee if not included in (3).

(5) a copy of the vetting procedures to be used on proposed artists / providers if not included in (3).

You specifically asked us to review:

1. That all responses were both complete and accurate.

2. If it was accurate that no information is held regarding the lead artist and fees for government campaigns.

3. A misunderstanding in what you had asked for in your original request in regard to contracts. And that you were looking for a copy of the contract between the Scottish Government and the relevant creative service agency.

I have concluded that the original decision should be confirmed with modifications.

I note that you were provided with a link to published information in response to point 1 of your original request. Under section 25(1) of FOISA, we do not have to give you information which is already reasonably accessible to you. If, however, you do not have internet access to obtain this information from the website(s) listed, then please contact me again and I will send you a paper copy.

Further, I can confirm that no information is held by the Scottish Government in relation to lead artists and fees for the reasons set out in the original response. This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested.

I apologise for the misunderstanding regarding point 3 of your request. I have attached a copy of this contract to this response.

An exemption under section 38(1) (personal data) of FOISA applies to some of the information within this contract. This is because it is names and details relating to individuals and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
