Information requested

Please provide any policy documentation, on disclosure of COPFS Direct Measures or Alternatives to prosecution, which states the process or procedure whereby these matters are disclosed on any PVG or Disclosure Scotland (All levels).

Response

Attached is a copy of all of the information requested. 

Disclosure Scotland has a Memorandum of Understanding (MOU) with Police Scotland in which the arrangements about Direct Measures/AtPs are referred. Direct Measures/ Alternatives to Prosecution may trigger a force enquiry on a higher level disclosure but are not shared automatically on any type of disclosure. ( please see excerpts from the MOU which refer to question you have raised). Disclosure Scotland will request the chief officer/chief constable provides any information they hold that meets the statutory tests in section 113B (4) of the Police Act 1997 or section 49(1)(c) Protection of Vulnerable Groups (Scotland) Act 2007.
