Information requested

1. Please provide all correspondence, between the Minister for Justice (including any Scottish Government officials),The Police Service of Scotland and the Scottish Police authority regarding the meeting held for the legitimate and lawful justification and evidence’s for High Risk data sharing to be changed from consent to public task.

2. To be clear, please provide all correspondence including but not limited to the exchange of letters emails/minutes of meeting, agenda’s and ministerial briefs (official sensitive information can be redacted) including telephone calls & records, conference calls & records, between the Scottish Government and the Police Service of Scotland, relating to: The meeting held on 15th July 2019.

Response

Unfortunately, an error in the calculation of working days occurred in this case. The non-working days which are set out in FOISA do not always match up to all of the public and privileged days which are allowed in the Scottish Government and did not include the recent September weekend. I apologise for this error on our part and the delay in providing this information to you.

I can now provide our response to your original request.

I enclose a copy of most of the information you have requested in the Annex

A small amount of personal information has been redacted from the document provided because an exemption under section 38(1)(b) of FOISA (personal information) applies to the names and contact details of officials and third parties who do not hold senior positions and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018. This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
