Correspondence between Scottish Government and Call It Out: FOI review

Information request and response under the Freedom of Information (Scotland) Act 2002

Information requested

Copies of any and all letter and email communications between the members of the Scottish Government (or those civil servants, or any advisors, or any special advisors, acting on their behalf) and any officers, directors or volunteers of Call It Out dated between 1st January 2020 and 31st August 2021 inclusive. Also any minutes of meetings that have involved Call It Out or its representatives.

Response

Further to my letter of 30 October 2021, I have now completed my review of our failure to respond to your request under the Freedom of Information (Scotland) Act 2002 (FOISA), dated 4 September 2021, for copies of any and all letter and email communications between the members of the Scottish Government (or those civil servants, or any advisors, or any special advisors, acting on their behalf) and any officers, directors or volunteers of Call It Out dated between 1st January 2020 and 31st August 2021 inclusive. Also any minutes of meetings that have involved Call It Out or its representatives.

In accordance with section 21(4) of FOISA, I have also reached a decision on your request.

I can now provide our response to your original request. I apologise for the delay in responding. There was an error in the case assignment process which meant your case was not appropriately filed. This was not done intentionally in order to withhold information, and I thank you for alerting us to this so we
could rectify the error.

I attach a copy of all of the information you requested as an attached pdf document.

An exemption under section 38(1)(b) of FOISA (personal information) applies to some of the information requested because it is personal data of third party which includes names and personal email addresses, and have subsequently been redacted. These are marked in the document as " [redacted]". Disclosing this would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018.

This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

Two lines in the disclosure document are redacted as they are not in the scope of this enquiry, as they are not either correspondence between the Scottish Government and Call It Out, nor are they information on meetings which representatives from Call it Out attended. These are marked on pages 23 and 35.
