Head of Civil Service voluntary resignation: FOI review

Information request and response under the Freedom of Information (Scotland) Act 2002

Information requested

Will the Head of the Civil Service in Scotland will receive any compensation on her voluntary resignation.

Response

I have concluded that the original decision should be confirmed, with some modification.

Having reviewed the case, I have found that the response of 22 July 2021 does not explicitly state whether compensation will be received, which in essence was what was being asked in your original request.

Therefore, the answer to your question is the Head of the Civil Service in Scotland will leave the civil service as planned when her term as Permanent Secretary concludes on 31 March 2022. Any pension payments that are due at this time will be made in line with normal rules. Any other contractual payments will be dependent on the circumstances at the time, such as pay in lieu of notice or payment for untaken leave days, so cannot be quantified at this time. These payments will be published in the annual Scottish Government Consolidated Accounts in due course (Publications - gov.scot (www.gov.scot)).

In your response email you have asked for some new information. As intimated in my letter of 30 July 2021, this is being handled as a separate FOI request case number 202100226963 and will be answered in due course.
