Information request and response under the Freedom of Information (Scotland) Act 2002
Information requested
How many individuals and companies in South Lanarkshire have been convicted of Littering and Fly Tipping over the 3 years from 2017-2020.
I would also like to know how much in total those convicted were fined.
Response
The latest available criminal proceedings in Scotland data is to 2019-20.
Information for offences of flytipping and littering is currently published as an additional dataset to our main statistical bulletin, which is available at this link under 'supporting documents' Criminal Proceedings in Scotland, 2019-20 - gov.scot (www.gov.scot).
Due to demand for area information, we are in the process of adding a breakdown of court proceedings by local authority to this dataset which will be available online in the next few weeks. In the meantime, I attach the revised workbook which will provide you with the information on convictions for South Lanarkshire. With regards to those receiving a court fine for the period in question, in 2016-17 a fine of £100 was imposed on a fly-tipping conviction and a fine of £200 for a littering conviction.
The attached workbook also provides the number of direct measures (non-court disposals) applied to these offences including experimental data based on the home location of the offender. Further information and explanations of direct measures is available in Annex D - D11 and D12, of the Criminal Proceedings bulletin mentioned above.
It is not possible to provide comprehensive figures on the numbers of people issued with fixed penalty notices (FPNs), as there is no legal requirement for organisations with the power to issue such penalties to provide reporting data to the Scottish Government.
