Information request and response under the Environmental Information (Scotland) Regulations 2004


Information requested

Under Freedom of Information I am requesting statistics for KSI (Kill & Serious Injury) type events on this route since data first collected, together with a formal update on the A82 Tarbet to Inverarnan improvement scheme to include current goverment commitment to see the work commence and complete (start and complete dates) and any impact on decision arising from the A83 R&BT problem. 

You clarified on 31 August –

1. Dates: ideally from first records to present date of your response, or if this is too onerous 2000 to 2021 your date of response.
2. KSI: incidents where fatality, serious injury has occurred. Minor incidents would ideally be of interest.
3. Comparison with other routes; in order to understand the information provided a comparison is needed with incidents occurring on other national arterial routes, eg A83, A9, A74.
4. Impact of A83 RaBT: in virtually the same geographic location there are two major transport route headaches.

Response

As the information you have requested is ‘environmental information’ for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.
