Information in relation to the winning tender received by the Scottish Government from 2i Limited for Testing Services.

We have now completed our search for the information you requested which has been attached below:
Please be aware that some of the information contained within this document has been redacted. Specifically, the redacted information is being withheld as the exemptions at the following sections of the Freedom of Information (Scotland) 2002 Act apply:-
- 33(1) (b) - Its disclosure under this Act would, or would be likely to, prejudice substantially the commercial interests of any person (including, without prejudice to that generality, a Scottish public authority);
- s38 (1) - The information relates to living individuals who would not have any expectation that the information would be released and if we were to release, we would be in breach of the Data Protection Act 1998.
As exemption s33(1) (b) is conditional we have applied the ‘public interest test’ to the information. This means we have, in all circumstances of this case, considered if the public interest in disclosing the information outweighs the exemption. We have found that, on balance, the public interest lies in favour of upholding exemption. We recognise there is a public interest in having transparent tender processes. On the other hand, if commercially sensitive information is made public, it is likely to damage the commercial interests of the company whose information is released. This, in turn, could mean the Scottish Government may be unable to generate genuine and effective competitive tendering processes, and that, in our view, would not be in the public interest.
The information supplied to you continues to be protected by the Copyright, Designs and Patents Act 1988.
