Meeting held with Police Scotland on 15 July 2019: FOI release

Information requested

As a Freedom of Information (Scotland) Act 2002 request please provide the following recorded information relating to the Monday 15 July 2019 meeting between Police Scotland and the Scottish Government where Public Task being the lawful basis for data sharing (including SC and CO data) with 3rd Sector Partners and Advocacy services (i.e. “criminal justice partners") was the subject of the meeting:

1. The Police Scotland roles who were in attendance at the Monday 15 July 2019 meeting between the Scottish Government and Police Scotland.

2. The agencies other than Police Scotland and the Scottish Government (e.g. the COPFS) who were present at the Monday 15 July 2019 meeting (should there have been any other agencies present).

3. The Scottish Government roles who were in attendance at the Monday 15 July 2019 meeting.

4. The names of the Scottish Ministers who were in attendance at the Monday 15 July 2019 meeting, should any have been in attendance.

5. The third sector organisations (i.e. list of Data Controllers) and/or class of organisation (e.g. specific type of third sector charity) that were recorded as being 3rd Sector Partners and Advocacy services (i.e. “criminal justice partners") with whom Police Scotland would share SC and CO data under Public Task that were recorded at the Monday 15 July 2019 meeting.

6. The version number of the Privacy Notice (or draft Privacy Notice) that was presented at the Monday 15 July 2019 meeting e.g. “Version 5 of July 2019” reference number V5-A0719 or “Version 6 of July 2019” reference number V6-A0719.

7. The statutory or common law basis (i.e. Act and section) that was recorded at the Monday 15 July 2019 meeting as giving a statutory gateway for processing as Public Task.

The conclusions from meeting on what was to be done about the personal data (including SC and CO data) that had been shared since 25 May 2018 without the Consent [as defined in Article 4(11)] of the Data Subject with Consent being the lawful condition for data sharing at the time the data was shared e.g. informing Data Subjects that their personal data had been shared unlawfully by Police Scotland without their Consent.

This FOISA 2002 request can be responded to with the minutes of the Monday 15 July 2019 meeting and appropriate Section 17(1) exemptions for the information requested in points 1 to 8 that was not recorded at this meeting.

Response

Attached is some of the information requested with the report of the meeting held on Monday 15 July 2019.

1/2. In relation to your requests listed numbers 1 and 2, organisations in attendance at the meeting have been listed within Annex A of the report. In relation to the names and roles of individuals outwith of the Scottish Government who attended this meeting, we have withheld this information under exemption s38(1)(b).

3. The names and roles of Scottish Government junior officials under Senior Civil Servant (SCS) level have been redacted under exemption s38(1)(b).

4. No Scottish Ministers were in attendance at this meeting.

5. All organisations who attended the meeting are listed at Annex A

6/7. Following an extensive electronic records search, I can confirm, in relation to the requests listed numbers 6 and 7, this information is not held by the Scottish Government.

8. The report from the meeting held on 15 July 2019 has been enclosed and contains the discussions and conclusions. Any other information requested is not held by the Scottish Government.
