First Ministers' meeting with business leaders: FOI release

Information requested

First Minister Nicola Sturgeon met business leaders on 25 October 2018, can you please provide the information below:

• Pre meeting briefing(s)
• Any agenda
• List of attendees at the meeting
• Any minutes or notes
• Any post meeting action points
• A copy of any speech/ pre-prepared words delivered to attendees
• Venue, cost of, and details of who paid for the dinner

Response

While our aim is to provide information whenever possible, in this instance we are unable to provide you with some of the information you have requested as an exemption under FOISA applies and the Scottish Government does not hold some of the information you have requested.

We do not hold a pre-prepared speech. As such, this is a formal notice under section 17(1) of FOISA that the Scottish Government does not hold some information that would fall within the scope of your request. Further information on which statutory exemption under FOISA applies can be found in the Annex A.

After performing a comprehensive search of our Scottish Government systems, the only documents found within the scope of your request were the official Ministerial briefing and the note of Innovation and Entrepreneurship briefing notes.

The agenda, attendees along with details of the venue are listed within the official Ministerial briefing. The cost of dinner was £1,295.76 and was met by Scottish Government.

ANNEX A

REASONS FOR NOT PROVIDING INFORMATION
Section 38(1)(b) – Personal data

This exemption applies to some of the information requested because it is personal data of a third party, i.e. names and contact details, and disclosing it would contravene the data protection principles in Article 5(1) of the General Data Protection Regulation and in section 34(1) of the Data Protection Act 2018.

This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
