Information requested

(i) Details of the Business and Regulatory Impact Assessment (BRIA) developed in response to the Restricting Food Promotions Bill - this may include drafts & final copy of the BRIA;

(ii) Details of correspondence (emails briefing papers) and meetings (dates, agendas, minutes) relating to this specific BRIA between: the Creating Health Team, Health Improvement Division; and the Minister for Public Health, Sport; Director for Population Health; Special Adviser(s); other teams, divisions or directorates within the Scottish government, from December 2019 to March 2020.

While our aim is to provide information whenever possible, in this instance we are unable to provide some of the information you have requested because exemptions under the following sections of FOISA applies to that information:

  • 29(1)(a) (formulation or development of government policy), and/or
  • 30(b)(i) (substantial inhibition of free and frank provision of advice), and/or
  • 30(b)(ii) (substantial inhibition of free and frank exchange of views for the purposes of deliberation).

The reasons why these exemptions apply are explained in the Annex to this letter.
