Court convictions for fly-tipping and non-court disposals: FOI release

You asked for:

1. The number of successful convictions secured for flytipping for the last five calendar years (i.e. 2014 to 2019) in Scotland?
2. The number of successful convictions secured for flytipping since the beginning of 2020 in Scotland?

Response

While our aim is to provide information whenever possible, in this instance the Scottish Government does not have some of the information you have requested. The reasons why we don't have the information are explained below.

The latest available information on court convictions for fly-tipping is provided in the attached excel workbook and we have also included data for non-court disposals where either Police Scotland or the Crown Office & Procurator Fiscal Service have issued direct measures. Local authorities have the power to issue fixed penalty notices for fly-tipping although this information is not held by the Scottish Government, hence the response here being only partially complete. Please also note that the legislation used to identify charges for fly-tipping is not exclusive to fly-tipping offences so some other related offences may be included.

The Scottish Government Criminal Proceedings database is not a live system and we are unable to provide information beyond the latest publication which is for the financial year 2018-19. Information on data covering the period 2019-20 will not be available until publication of our 'Criminal Proceedings in Scotland, 2019-20' bulletin which is expected to be published early next year. This means we are also unable to provide information since the start of 2020.
