In this instance the Scottish Government is able to provide some information which may be of interest to you, however, this information does not fall within the scope of your request. This is because the formal response provided to the Office of the High Commissioner for Human Rights (OHCHR) was submitted by the UK Government on behalf of the UK as the state party. The Scottish Government contributed to that overall state party response. It did not respond separately to the questionnaire. I am therefore in a position to provide you with the information submitted by the Scottish Government to the UK Government for inclusion in the UK response, but am not able to provide the response which the UK Government subsequently submitted to the OHCHR
To the extent to which your request relates to the overall UK response to the questionnaire, this letter constitutes a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested. .
The information submitted by the Scottish Government in connection with the questionnaire is contained in the Annex to this letter. I trust this will be of assistance.
The UK Government answered a Parliamentary Question on 18 December 2018 about its response to the UN Global Study on Children Deprived of Their Liberty (see https://www.parliament.uk/business/publications/written-questions-answers-statements/writtenquestion/Commons/2018-12-13/202092/) and then deposited the UK response in the libraries of the UK Parliament. Therefore the UK’s response is publicly available.
