Convictions under Section 34 of Sexual Offences (Scotland) Act 2009: FOI release

Information request and response under the Freedom of Information (Scotland) Act 2002.


Information requested

1 - Numbers of people convicted under section 34 of the Sexual Offences (Scotland) Act 2009 during 2017-18 - excluding those charged with other offences at the same time.
2 - Of the individuals in question 1, for how many of those was this their first conviction of a sexual crime.
3 - Of the individuals in question 2, how many of those individuals received a custodial sentence?
4 - If applicable, of those who received a custodial sentence, what was the shortest, longest and average sentence handed out in relation to their conviction under section 34.

Response

1 - Excluding individuals charged with joint offences including section 34 together with sections 33 and 35, and those charged with other offences, there were 11 people convicted under section 34 of the Sexual Offences
(Scotland) Act 2009 during 2017-18.
2 - This was the first conviction of a sexual crime for 10 of these individuals.
3 - Of the 10 individuals in question 2, 1 received a custodial sentence.
4 - The only custodial sentence was for 274 days.
