Public correspondence on Sheriff’s decision in Christopher Daniel case: FOI release

Information requested

 

1. Copies of any letters/emails sent by members of the public to the First Minister on the subject of or relating to the decision in PF v Christopher Daniel.
2. Copies of any letters/emails sent by members of the public to the Cabinet Secretary for Justice on the subject of or relating to the decision in PF v Christopher Daniel.
3. Copies of any letters/emails sent by members of the public to the Lord Advocate on the subject of or relating to the decision in PF v Christopher Daniel.

 

Response

 

I enclose a copy of the information you requested in Part 1 and 2 of your FOI request in PDF format.
However, an exemption under section 38(1)(a) and (b) of FOISA applies to some the information you have requested. This is because it consists of the names, contact details and other information which may identify members of the public who have written to the Scottish Government about this case, and disclosing it would contravene the data protection principles in Schedule 1 to the Data Protection Act 1998.

This exemption is not subject to the ‘public interest test’, so we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.

For Part 3 of your request, the Scottish Government does not have the information you have asked for.
This because the Scottish Government does not hold any letters/emails sent by members of the public to the Lord Advocate on the subject of or relating to the decision in PF v Christopher Daniel. This is a formal notice under section 17(1) of FOISA that the Scottish Government does not have the information you have requested.
