How many planning application refusals, originally refused by City of Edinburgh Council), were successfully overturned on appeal to the Planning and Environmental Appeals Division (DPEA) for the following calendar years of 2017, 2018 and 2019 to date?

Supplementary Request received 20 June : How many planning application refusals, originally refused by City of Edinburgh Council, were unsuccessful for the same years?

Response

In 2017, *20 planning permission appeals in total were received as a result of decisions made by Edinburgh City Council. Of those decisions 7** valid appeals related to the council’s refusal to grant planning permission. 2 of those appeals were allowed (planning permission granted) and 5 of those
appeals were dismissed (planning permission refused).

In 2018, *40 planning permission appeals in total were received as a result of decisions made by Edinburgh City Council. Of those decisions 19** valid appeals related to the council’s refusal to grant planning permission. 7 of those appeals were allowed (planning permission granted) and 12 of those
appeals were dismissed (planning permission refused).

In 2019*** , *11 planning permission appeals in total were received as a result of decisions made by Edinburgh City Council. Of those decisions 5** valid appeals related to the council’s refusal to grant planning permission. 1 of those appeals was allowed (planning permission granted), and 4 of those
appeals were dismissed (planning permission refused).

* The figures detailing the total number of appeals received in each year is provided for context purposes only and includes appeals received in which DPEA either had no remit to consider, were subsequently withdrawn by the appellant or were submitted as a result of conditions imposed on a permission (not refused by the authority).

**The figures relating to the numbers of appeals allowed/dismissed as a result of a decision to refuse planning permission by Edinburgh City Council does not include appeals submitted as a result of a ‘deemed refusal’. This is where a council has taken longer than the prescribed timescale to determine an application and the applicant has decided not to await the final decision but elected to submit what is known as a ‘deemed refusal appeal’.
