Cost of maintaining and upgrading the A96 Aberdeen/east of Huntly: EIR release

Information requested

If Transport Scotland’s proposed new A96 dual carriageway, Aberdeen to East of Huntly section goes ahead, Aberdeenshire Council will become responsible for the maintenance and care of the declassified A96. What has been the annual cost, for the last 5 years, of maintaining and upgrading the existing A96 in the above area ie Aberdeen to East of Huntly?


As the information you have requested is ‘environmental information’ for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations.  We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA. 

This exemption is subject to the ‘public interest test’.  Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption.  We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes.  This is essentially a technical point and has no material effect on the outcome of your request.

We have applied regulation 10(4)(a) of the EIRs to the first part of your request regarding the amount spent on the A96 above Aberdeen to the East of Huntly. The reason why that exception applies is that these costs are part of a maintenance budget for the entire route and we are unable to breakdown by route area.  We are however able to give you information in relation to spend on road maintenance for the whole of the A96.
