Information requested

Can you please provide me with a copy of:

The Roads (Scotland) Act 1984 –Transitional Order – Restricted and Non-Restricted Roads 1985, including the Schedules annexed to the same.

The details of the proposals of the THE A82 TRUNK ROAD (INVERNESS) (30MPH SPEED LIMIT) ORDER 2007.

If held, the full reports of any traffic survey (in machine readable format if available) conducted on the stretch of road from the Tomnahurich Canal Bridge southwestwards for a distance of 200m or thereby.

As the information you have requested is 'environmental information' for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

This exemption is subject to the 'public interest test'. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption. We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.

Response

In relation to The Roads (Scotland) Act 1984 –Transitional Order – Restricted and Non-Restricted Roads 1985, we have applied exception at regulation 10(4)(a) of the EIRs. The reason we have applied this exception is that Transport Scotland no longer holds this order. This order has been removed from our records.

The A82 Trunk Road (Inverness) (30mph Speed Limit) Order 2007 is available from the OPSI website. A link to this is provided below.

The revoked order named The A82 Trunk Road (Longman Road, Inverness) (30mph and 40mph Speed Limits) Order 1998 is available at Annex B of this request. The second revoked order, The A82 Trunk Road (Telford Street Roundabout to Rose Street Roundabout, Inverness) (Temporary 30mph Speed Limit) Order 2005 is available at Annex C.

The enclosed information at Annex D is taken from one of our automatic traffic counters which is located approximately 600m South West of the swing bridge. The data from this counter extends back to the start of April 2017, and I have included information to the end of June 2018.
