Response
Social Security Scotland takes its advice on legal matters from the Scottish Government Legal Directorate. On occasion, they may choose to refer matters on our behalf to an independent legal firm. It is the spend on that external advice which is captured in the response below.

In response to your Request for Information 3, we consider that this information is exempt under Section 38(1)(b) of FOISA. This exemption in not subject to the ‘public interest test’ and as such we are not required to consider if the public interest in disclosing the information outweighs the public interest in applying the exemption.
