Emissions Reduction Claims by Maritime Operators (Scotland) Direction 2026
A Direction given by the Scottish Ministers under section 52 of the Climate Change Act 2008 to the Scottish Environment Protection Agency.

([b]) Section 52(1) of the Climate Change Act 2008 (“the 2008 Act”) confers upon “the relevant national authority” the power to give directions to the administrator of a trading scheme. The Scottish Ministers are a “relevant national authority” by virtue of section 47(2) of the 2008 Act and article 9(3) of the Greenhouse Gas Emissions Trading Scheme Order 2020 (“the UK ETS Order”) provides that the Scottish Environment Protection Agency are an administrator of the UK ETS for the purposes of paragraph 21 of schedule 2 of the 2008 Act (appointment of a person as administrator of a trading scheme).
([c]) S.I. 2020/1265. Schedule 2A is to be inserted into the UK ETS Order by article 4 of the Greenhouse Gas Emissions Trading Scheme (Amendment) (Extension to Maritime Activities) Order 2026 and has effect from 1 July 2026.
