Domestic Homicide and Suicide Reviews in Scotland: Protocol
The protocol sets out the arrangements that are to be followed to help prevent Domestic Homicide and Suicide Reviews causing prejudice to criminal investigations, other investigations, criminal proceedings, a Fatal Accident Inquiry or a public inquiry which Scottish Ministers are solely responsible.
6. Revocation
A notifying body can revoke a notification where this has been made in error or where further information has come to light and the notifying body no longer believes a death is reviewable. The Scottish Ministers may revoke a referral where it believes a death is not reviewable. On receipt of a revocation notice, the Review Oversight Committee are to treat the notification or referral as if it had never been received.
Where a revocation notice is received a copy must be sent by the notifying body to the Scottish Ministers. Where the revocation notice is made by the Scottish Ministers they must provide a copy in writing to each notifying body.
Following a decision by the Review Oversight Committee as to whether a death which has been notified or referred is a reviewable death, a revocation can no longer be made.
