Domestic Homicide and Suicide Reviews in Scotland: Protocol
The protocol sets out the arrangements that are to be followed to help prevent Domestic Homicide and Suicide Reviews causing prejudice to criminal investigations, other investigations, criminal proceedings, a Fatal Accident Inquiry or a public inquiry which Scottish Ministers are solely responsible.
18. Freedom of Information and Subject Access Requests
The information received as part of a review will be held by the Secretariat and will therefore, in principle, be subject to Freedom of Information (FOI) legislation. Any FOI request which is received will be considered individually to determine whether the requested information is held and whether it can be released in whole or in part. FOI legislation includes a number of exemptions which would potentially be relevant to a review, including an exemption under section 38 of the Freedom of Information Act (Scotland) 2002 which can permit the withholding of personal information about a third party.
Individuals have the right to make a Subject Access Request (SAR) to request a copy of any personal data about them from organisations which are data controllers. Individual bodies will have their own protocols under which SARs will be received and processed. Where a SAR is made to the Review Oversight Committee this will be considered by the Secretariat in line with Scottish Government processes and procedures.
