Children looked after by local authorities: legal framework

This report describes key aspects of the law as it applies throughout a child's journey through public care and supervision.

I am grateful to many staff at the Scottish Executive who provided ready access to references, guidance and regulations and information about forthcoming implementation of legislation, and to Margret Coutts, Social Work Services Policy Division, Dr Mike Gibson, Head of Additional Support for Learning Unit, and Dr Linda de Caestecker, Greater Glasgow Health Board and former Head of the Health Department Women and Children's Unit for their advice on content, direction and national policy. I received invaluable help from Sheriff Brian Kearney; Janys Scott, Advocate; Jacquie Roberts and Lyndy Boyd from the Scottish Commission for the Regulation of Care; Alan Miller, former principal reporter and now part-time sheriff, and Frances Roberts from the Scottish Children's Reporter Administration, Professor Kenneth Norrie, Head of the Law School at the University of Strathclyde, and Lexy Plumtree, Legal Advisor to BAAF. All gave generously of their time and expertise and contributed excellent information, advice and comment on the law and its context. Their help was greatly appreciated.

The content of this report does not necessarily reflect the views of the Social Work Inspection Agency or the Scottish Executive or the people who supported this study.
