  1. any internal communications between 1st January 2015 and 31st December 2015 discussing the CalMac ferries contract
  2. a copy of the CalMac ferries contract that was, reportedly, signed by Derek Mackay (Finance Secretary of the time of the contract)
  3. a copy of the renewed changes to the contract in November 2016
  4. a copy of the renewed changes to the contract in May 2017
  5. a copy of any minutes of meetings between 2015-2017 relating to the CalMac ferries contract

The contract was awarded by CMAL in its capacity as procuring authority following a robust procurement process. Transport Scotland and CMAL ensured that Ministers were informed of, and accepting of, the risks associated with this contract. These exchanges have been set out in the public record since 2019.

Mr Mackay did not sign the contract (Jim McColl FMEL and Tom Docherty CMAL did). A redacted version of this document has been on our website since 2019 and can be found at the following link here

The document confirming which Scottish minister agreed to proceed with offering Ferguson Marine Engineering Limited a contract for the building of new ferries in October 2015 has been provided to Parliament and can be found on the Scottish Government website here

As the information you have requested is ‘environmental information’ for the purposes of the Environmental Information (Scotland) Regulations 2004 (EIRs), we are required to deal with your request under those Regulations. We are applying the exemption at section 39(2) of the Freedom of Information (Scotland) Act 2002 (FOISA), so that we do not also have to deal with your request under FOISA.

This exemption is subject to the ‘public interest test’. Therefore, taking account of all the circumstances of this case, we have considered if the public interest in disclosing the information outweighs the public interest in applying the exemption.

We have found that, on balance, the public interest lies in favour of upholding the exemption, because there is no public interest in dealing with the same request under two different regimes. This is essentially a technical point and has no material effect on the outcome of your request.
